Since the beginning of labor relations there have been problems related to communication, treatment and, in general terms, all the fundamental aspects surrounding the link between the employee and the employer, given these circumstances it was necessary that within the system Colombian legal system will establish the appropriate mechanisms to avoid any abuse against the worker, which as a general rule, is the part that needs to be protected since it holds the position of least hierarchy within the labor nexus. Not only was it necessary to implement mechanisms that would allow access to the jurisdiction to people who were affected by this type of behavior, but also the need to develop comprehensive alternatives, with which it will be effectively solved, or at least diminish, the indexes of labor harassment, being the obligation of the legislator to establish the guidelines that compose this figure, the adequate procedures to make effective the rights that are in play and, above all, the preferential treatment to the people violated in their rights. Coupled with the fact that not only Colombian legislation has developed these tweets, international treaties on Human Rights, included through the Constitutionality Block (Article 93 CP), oblige the State to strive to combat this scourge. It is intended to provide the recommended approach, determine preventive actions, promote compliance with the law, among other forms or methods directed to state entities in order to effectively use this rule and at the same time improve the control of situations that have harmed some state workers On the part of the comrades, the possibility was raised of delimiting the situation of labor harassment specifically directed to a particular case, under this assumption it has been thought to look for a case within the armed forces specifically police or military force, where statistically they have been highlighted cases of labor harassment by superiors. Under the previous assumption, a given problem was also raised, starting with the compensation made by the respective entity and the analysis of how the entities should take out of their budget such compensation that repeat actions are made against those officials who have committed these behaviors against their subordinates."

En la práctica se da el desconocimiento de la norma, la confusión, la falta de compromiso de los funcionarios y e incluso temor a denunciar dichas situaciones, teniendo como base que el acoso laboral se presenta desde muchas perspectivas. Desde el inicio de las relaciones laborales se han presentado problemas relacionados con la comunicación, el trato y en términos generales todos los aspectos fundamentales que rodean al vínculo existente entre el empleado y el empleador, una vez dadas estas circunstancias se hizo necesario que dentro del sistema jurídico colombiano se establecieran los mecanismos idóneos para evitar cualquier maltrato en contra del trabajador, que como regla general, es la parte que necesita ser protegida puesto que ostenta la posición de menor jerarquía dentro del nexo laboral. No sólo se necesitaba implementar mecanismos que le posibilitaran el acceso a la jurisdicción a las personas que se viesen afectadas por este tipo de conductas, sino también la necesidad de desarrollar alternativas integrales, con las cuales se solucionara efectivamente, o al menos disminuyeran, los índices de acoso laboral, siendo obligación del legislador establecer los lineamientos que componen esta figura, los procedimientos adecuados para hacer efectivos los derechos que se encuentren en juego y, sobre todo, el trato preferente a las personas vulneradas en sus derechos. Aunado al hecho de que no sólo la legislación colombiana ha desarrollado estas medidas tuitivas, los Tratados internacionales en materia de Derechos Humanos, incluidos a través del Bloque de Constitucionalidad (art. 93 C.P.), obligan al Estado a esforzarse en la lucha contra este flagelo. Se pretende aportar el planteamiento recomendable, determinar acciones preventivas, promover el cumplimiento de la ley, entre otras formas o métodos dirigidas a entidades estatales con el fin de utilizar de forma eficaz esta norma y a la vez mejorar el control de situaciones que han perjudicado a algunos trabajadores estatales Por parte de los compañeros se planteó la posibilidad de delimitar la situación de acoso laboral específicamente dirigida a un caso en particular, bajo este supuesto se ha pensado buscar un caso dentro de las fuerzas armadas específicamente policía o fuerza militar, en donde estadísticamente se han resaltado casos de acoso laboral por parte de superiores.
