Summary:The following paper will show the research done to define and propose a solution for the problem with street sellers. The main objective is to present a proportionality test by counterpose the collective rights against the fundamental rights. It will define the laws that control this process as well as the rights that belong to the people that posses this way of life, and will also analise the different scenarios where the Colombian congress has to act to manage the situation. In conclusion, it will define if the human rights of these people are being violated by looking through all the perspectives of the laws that apply to them, while it is found if the ‘legitimate trust’ is given
