Description
Summary:Colombia is a country that has been characterized by having a great potential in nonrenewable natural resources (RNNR) that among the most prominent are the minerals and hydrocarbons. Despite representing an important factor in the national economy the extraction of these resources, since 2013 these extractions have generated some controversy in some municipalities in the departments of Tolima and Casanare, since before the nonconformity of the community for such withdrawals, their Municipal Councils have called for a Referendum to decide on the use of these resources. These legal effects generated by the decisions of these mechanisms for citizen participation have sparked great controversy at the state, contractual and municipal levels. Therefore, in this research work, in addition to capturing the importance and topicality of the problem, explain the regulations and case law governing the case in question and in fact will release the incidents why these phenomena occur undoubtedly some if not treated on time in the future affect the vast majority of Colombian municipalities
