Description
Summary:The Commercial Agency appears frequently in numerous commercial relations of the activity of contemporary commerce. A clear example can be identified in the usual non-regulated practice of sale or distribution of specific trademark, or non-proprietary products that unconsciously generate profits or affect the assets of a particular entrepreneur. However, there is an extensive legal loophole regarding the definition and subsequent verification in judicial matters of the Hecho Commercial Agency. It is therefore, common in numerous cases that a network of confusion about this contract can affect the resolution motive of the Administrator of Justice with similar ones such as the supply or distribution. Therefore, it is necessary to analyze the importance that this legal relationship represents for the current commercial law. Additionally, identify its main characteristics, differences with similar commercial contracts, and finally establishing the different verification criteria derived from the jurisprudence pronounced, in this respect, during the Last 5 years. This work consists of a brief analysis on some judgments of the Supreme Court of Justice, as well as the State Council, and views on the different studies that have proposed some of the most prominent Doctors of Modern Civil and Commercial Law on the Agency of Fact
