Summary:"This essay is the result of the different conferences received at the scheduled seminar for the Gran Colombia University, conducted the Florida International University (FIU), which allowed us as students of the Faculty of Law, obtain fundamental knowledge about the American criminal accusatory system and therefore see the advantages in some aspects to be discussed below and their possible application in the Colombian penal system. In this order of ideas, we will take a brief tour of the different conferences, mentioning among others, the fourth, fifth, sixth and fourteenth amendments, and some features of American criminal accusatory system, the functions or roles of judges, lawyers and prosecutors Americans and we stop to deepen the most important issue in my view, as are the ""preliminary agreements"" with its advantages without prejudice some disadvantages as well as the experiences and results obtained in the practice of the American adversarial system that allows us to get a conclusion. Finally, we will approach other issues such as due process and the death penalty, the latter on the ground that as law students, we draw much attention, that it was the first power in the world, a civilized society and therefore a model to follow, even the death penalty is applied in cases of felonies or serious and classified as major crimes, but the trend is slowly abolish the practice in some states, and in this order of ideas, it is interesting to see how the executive, in this case the Governor has in his hands the decision to apply or not, even if the judiciary has determined and ordered his execution"
