RESUMEN: En este artículo se realiza un análisis iusfilosófico de la doctrina sobre las relaciones entre las categorías «tipicidad» y «antijuridicidad» elaborada por la dogmática penal germanista, teniendo como marco la doctrina de los operadores deónticos «prohibido» y «permitido» de la teoría general del derecho. Este análisis se encamina a sentar las bases argumentales respecto de la pertinencia que tiene incorporar la distinción «permisos fuertes»«permisos débiles» de la teoría general del derecho a la doctrina del injusto penal, concretamente en el tratamiento conceptual de algunos supuestos de exención de responsabilidad que son concebidos por parte de la dogmática penal germanista como situaciones de necesidad exculpantes y que podrían ser consideradas, en tanto permisos (débiles), como “causas” de justificación. |
