RESUMEN: En este artículo se desarrolla la línea jurisprudencial sobre la subsistencia de las comunidades locales en Colombia, utilizando el método de análisis dinámico del precedente, propuesto por el profesor Diego López Medina, en el cual, mediante una “ingeniería de reversa”, se determinan las sentencias hito, las sentencias fundadoras y confirmadoras de jurisprudencia, buscando describir cómo los jueces, y especialmente la Corte Constitucional y el Consejo de Estado, han respondido en torno a la protección del derecho de subsistencia de las comunidades locales: indígenas, afrocolombianos y campesinos, teniendo en cuenta la estrecha relación de estas con el medio natural en el que habitan. Además se problematiza el concepto legal de subsistencia, planteando su transformación al pasar de una mera enunciación legal a convertirse en un derecho fundamental, por interpretación constitucional, para estas comunidades. |

Además se problematiza el concepto legal de subsistencia, planteando su transformación al pasar de una mera enunciación legal a convertirse en un derecho fundamental, por interpretación constitucional, para estas comunidades.ABSTRACT: This article develops the line of case law on the livelihoods of local communities in Colombia. We use the method for dynamic analysis of precedent, proposed by Professor Diego Lopez Medina, in which, through a “reverse engineering”, defines the “Landmark Decisions, Founders Decisions and Confirmation Decisions”, seeking to describe how the judges, and especially the Constitutional Court and the Council of Sate, have responded on the protection of the right of subsistence for local communities: indigenous, Afro-Colombian and peasants, bearing in mind the close relationship of these with the natural environment in which they live.
