RESUMEN: Este artículo analizará los fundamentos y las consecuencias sociojurídicas de los sistemas de responsabilidad penal juvenil, lo cual toma gran importancia en Colombia pues se viene hablando de tiempo atrás de la urgencia de modificar dicho sistema. La ausencia de una literatura especializada ha dado lugar a todo tipo de juicios en varias direcciones que nada bueno han dejado en lo que respecta al pensamiento de la responsabilidad juvenil en un país donde la situación de delincuencia entre los menores de edad es asunto más que grave. Entonces, ante la disyuntiva que se nos pretende plantear (entre un sistema penal juvenil represivo o la impunidad), el investigador debe ahondar en presupuestos filosóficos y sociológicos para proponer otras alternativas reales y concretas para una reforma, enfocado especialmente en la comprensión de lo juvenil (que implica un diálogo de saberes), la representación –función en el mundo de lo real cotidiano del sistema jurídico penal–, y la figura del juez en dichos procesos, entre otros elementos. De esta manera, este artículo ahondará en los elementos sociojurídicos que se consideran más relevantes para servir de fundamento teórico del proceso de reforma del sistema de responsabilidad juvenil. |

De esta manera, este artículo ahondará en los elementos sociojurídicos que se consideran más relevantes para servir de fundamento teórico del proceso de reforma del sistema de responsabilidad juvenil.ABSTARCT: This article will analize the socio-juridical bases and consequences to the systems of juvenile penal responsibility which turns greatly important in Colombia, for the urgency to modify such a system has been in discussion since a while back. The lack to specialized literature has brought forth all types of judgments into various directions which has left nothing good as far as juvenile responsibility is concerned, in a country where the situation of delinquency amongst minors is becoming a more than a grave issue. Thus, before the disjunction expounded in front of us between a repressive juvenile penal system and impunity the re-searcher should thoroughly study the philosophical and sociological suppositions in order to propose other real and concrete alternatives tor a reform especially focused upon the understanding of what relates to a juvenile I which implies a dialogue amongst knowledges!, of the representation - a function in the world of the true daily juridical penal system, and of the judge figure in such processes, among other elements.
