description RESUMEN: De acuerdo con la Constitución Política de Colombia, el Estado es el propietario del subsuelo y de los recursos naturales renovables y no renovables. Esta propiedad y su conservación están reguladas en la Ley 685 de 2001. Esto indica que la concesión de derechos de uso sobre el subsuelo y sus recursos debe realizarse de forma armónica con los aspectos jurídicos y sobre todo, privilegiando el bien general. En la actualidad la dinámica del sector minero ha permitido la intervención del sector inversionista interesado en los recursos del subsuelo colombiano. Esto ha mostrado la sugerencia de generar una normatividad que responda de forma eficiente, en materia de producción, reservas ambientales, demandas de titulación, de delimitación geográfica de áreas de posible contratación, eficacia en las compensaciones ambientales, entre otros. Esto ha incidido en la generación de grandes retos en lo normativo, lo político, lo ambiental y lo social.

This property and its preservation are regulated by law 685 of 2001. This indicates that the granting of rights to use the subsoil and its resources must be in harmony with the legal aspects and above all, favoring the general good. At present the dynamics of the mining sector has led to the intervention of investment sector interested in Colombian subsoil resources. This has shown the suggestion of creating a regulation that responds efficiently in production, environmental reserves, demands for qualifications, geographic delimitation of areas of possible recruitment, effectiveness in environmental compensation, among others.
