RESUMEN: De acuerdo al esquema del proceso judicial adoptado por el Código General del Proceso, el juez ha sido investido de poderes y facultades para actuar como conciliador, teniendo como uno de sus deberes el exhortar a las contrapartes a conciliar en cualquier momento antes de dictar sentencia, incluso, de proponer fórmulas de arreglo que pueden favorecer a alguna de las partes. Este artículo pretende analizar si la imparcialidad del juez se ve afectada con ocasión de esta facultad conciliatoria, no sólo con lo anteriormente expuesto, sino también al seguir conociendo del proceso cuando la conciliación se declara fallida y que puede derivar en un prejuzgamiento al emitir su fallo. Conforme al análisis realizado, es posible que se vea afectada la imparcialidad del juez, por lo que se recomienda que sea otra persona diferente al juez, la encargada de agotar la conciliación como una etapa del proceso judicial, ya sea que el conciliador esté inscrito en un Centro de Conciliación o que se conforme una Lista de Auxiliares de la Justicia. |

This article aims to analyze whether the impartiality of the judge is affected by this conciliatory power, not only with the aforementioned, but also by continuing to know the process, when the conciliation is declared failed, which may result in a prejudgment when issuing his decision.
