RESUMEN: Los países andinos como Colombia, depositarios de gran biodiversidad, se han vuelto objetos de atención por parte de países desarrollados y altamente industrializados, de forma tal que en aras de la integración económica se insertan en nuestros ordenamientos legislaciones en materia de Propiedad Intelectual sobre los recursos naturales. Un claro ejemplo de ello es la Decisión Andina 391 de 1996, esto es, el Régimen Común de Acceso a los recursos genéticos, el cual parte de la premisa de separar el componente tangible (plantas, animales, microorganismos) y el componente intangible (conocimiento tradicional) de la biodiversidad. De esta manera, en este artículo de investigación, a partir de la descripción del concepto de comunidades locales y del marco regulatorio sobre acceso a los recursos genéticos, se analiza como al separar el Estado, proveedor del componente tangible, y a las comunidades locales, proveedoras del intangible, se configura una limitación al reconocimiento de los derechos colectivos sobre la biodiversidad, que son el resultado del papel protagónico que han desempeñado las comunidades indígenas, campesinas y afrodescendientes, en la conservación y uso sustentable de la diversidad biológica. |

A example of that is the Andean Decision 391 of 1996, that is, the Common Regime of Access to the genetics resources, which starts with the premise of separate the tangible component (plants, animals, microorganism) and the intangible component (traditional knowledge) of the biodiversity.
