Summary:This article is aimed to analyze what does the crisis in rationality mean from the legal and political elements that gave rise to the rupture in modern thinking and set up the foundations for postmodernity. There is evidence along this paper regarding how this event produces a paradigm change in legal thinking. The dogmatic methodology is used as the main one. The first part of the document presents how the crisis in modernity came about; the second one analyzes Carl Schmitt’s postulates; the third one shows the most important arguments in the legal and political fields of that time and, finally, the text offers some conclusions.
