Summary: | The essay analyzes the contemporary paradigms of criminology’s juridical projection, especially Luigi Ferrajoli’s penal garantism, by comparing it with the critical theory of human rights (Hinkelammert, Sánchez Rubio and Herrera Flores). The tension between penal garantism and the critical theory of human rights allows the identification of virtues and limitations of both theories, as well as concrete possibilities of dialogue and harmony, aiming, eventually, at the reduction of damages caused by the always excessive incidence of penal system agencies. |
