Summary:This article analyzes the concept of public service as a constitutive element of the rule of law function that is contrasted with the policies of provision of these services under the so-called “neoliberal”current. Similarly the analysis of the solution given by the Constitution of 1991 is studied, which aims to harmonize the provision of these in the context of market economy and simultaneously achieve compliance with the essential purposes of the rule of law. Also the concrete results for some harmonization project of some utilities will be analyzed.
