Article 1 of Law 114 mentioned is as follows: "Official primary school teachers who have served in the teaching profession for a term of not less than twenty years are entitled to a lifetime retirement pension, in accordance with the provisions of this law." Number 3 of article 4 ib. He points out that in order to enjoy the grace of the pension, the interested party must, among other things, prove “that he has not received nor is he currently receiving another pension or reward of a national nature.

He points out that in order to enjoy the grace of the pension, the interested party must, among other things, prove “that he has not received nor is he currently receiving another pension or reward of a national nature.La pensión jubilación de gracia es una prestación, creada por la ley 114 de 1913, comenzó siendo una prerrogativa gratuita que reconocía la Nación a cierto grupo de docentes del sector público, los maestros de educación primaria de carácter regional o local; grupo que luego, que se expidieron las leyes de 116 de 1928 y ley 37 de 1933, se amplió a los empleados y profesores de las escuelas normales, a los inspectores de instrucción pública y a los maestros de enseñanza secundaria de ese mismo orden y se dice que constituye privilegio gratuito porque la nación hace pago sin que el docente hubiese trabajado para ello. El artículo 1° de la ley 114 mencionada es del siguiente tenor: “Los maestros de escuelas primarias oficiales que hayan servido en el magisterio por un término no menor de veinte años, tienen derecho a una pensión jubilación vitalicia, en conformidad con las prescripciones de la presente ley”. El numeral 3° del artículo 4° ib.
