description	The purpose of this article is to review the link between the thought of Thomas Aquinas in the theological-political problems that are going through his time, since the so-called "Investiture Controversy" and its resolution in the Worms concordat of 1122. For this, we will trace some fundamental elements of medieval law and its relation to the problem of the relationship between the eternal law, the natural law and human law. It is proposed to defend the idea that the Angelic Doctor resists becoming a point of articulation between a medieval and a modern conception of State, that begins to dazzle the latter of the tutelage of the Church, to rescue its own legitimacy in the search for the common Good.

Para ello, se rastrean algunos elementos fundamentales del derecho medieval y su relación con el problema tomista de la relación entre la ley eterna, la ley natural y la ley humana. Se propone defender la idea de que el Doctor Angélico se sitúa en un punto de articulación entre una concepción medieval y una moderna del Estado que empieza a desligara a este último de la tutela de la Iglesia, al rescatar su legitimidad propia en la búsqueda del bien común.Le présent article a pour but de passer en revue l'ancrage de la pensée de Thomas d'Aquin dans les problèmes théologico-politiques qui se posent à son époque depuis la soi-disant "dispute de l'investiture" et sa résolution dans le Concordat de Worms de 1122. À cette fin, certains éléments fondamentaux du droit médiéval et leur relation avec le problème thomiste de la relation entre la loi éternelle, la loi naturelle et la loi humaine sont retracés. Il est proposé de défendre l'idée que le Docteur Angélique se situe à un point d'articulation entre une conception médiévale et une conception moderne de l'État qui commence à dissocier ce dernier de la tutelle de l'Église, en récupérant sa propre légitimité dans la recherche du bien commun.O presente artigo visa rever a ancoragem do pensamento de Tomás de Aquino nos problemas teológico-políticos que se têm desenrolado no seu tempo desde a chamada "disputa de investidura" e a sua resolução na Concordata de Minhocas de 1122. Para este fim, são traçados alguns elementos fundamentais do direito medieval e a sua relação com o problema tomístico da relação entre o direito eterno, o direito natural e o direito humano.
