This research focuses on two main axes: one of historical and other education, assessing the in‑uence of dictatorial politics and gender segregation that sets a new educational system in Spain. The method used in this research has been the historical comparative analysis and supplemented by some quantitative analysis. To obtain a historical interpretation from a disciplinary perspective, other disciplinary sciences to history of education, such as sociology and statistical sciences have been used. The findings show the political-patriotic and religious character that the public school system takes, along with the disappearance of the model of coeducation. The appearance of modernity that they tried to give to the 1953 Act did not prevent the Falange and the Church from maintaining a determining role at this educational level. Eorts of having women in a second place in society were postponed due to economic development, from the Fifties, which boosted an unusually high number of female teachers and students in the institutes that came to be named as “Enseñanza Media”. Este artículo es el producto de una investigación sobre la legislación en materia de educación secundaria durante el Franquismo, con el objetivo de aportar una valiosa información sobre la génesis y desarrollo de un nuevo sistema de enseñanza secundaria que se fue gestando con la promulgación de las Leyes de 1938 y 1953 y el papel de las mujeres dentro de este nivel educativo. Esta investigación gira en torno a dos ejes fundamentales, uno de carácter histórico y otro educativo, valorando la inuencia de la política dictatorial y la segregación sexista que congura un nuevo sistema educativo en España. El método seguido en esta investigación ha sido el histórico, complementándolo con análisis comparativos y con algunos análisis cuantitativos. Para obtener una interpretación histórica desde una perspectiva disciplinar se han utilizado otras ciencias auxiliares a la historia de la educación, como la sociología y la estadística. Las conclusiones muestran el carácter político-patriótico y religioso que adquiere el sistema público de enseñanza, junto con la desaparición del modelo de coeducación. El barniz de modernidad que intentó dar la Ley de 1953, no impidió que la Falange y la Iglesia siguiesen teniendo un papel determinante en este nivel educativo.
