Most of the Western countries have adopted democratic political systems and a capitalist economical system of production in where is necessary to give recognition to private property.This paper aims to present how transfers of property take place under Common Law, focusing on personal property issues, and comparing them with other legal systems in South America that have different rules for transfer of property.La forma de un estado influye en la regulación de los derechos de propiedad. Loanterior en razón a que el concepto de propiedad tiene consecuencias directas sobrela cuestión de la distribución de la riqueza y el poder económico, del papel de losgobiernos y de la autonomía de los ciudadanos, lo que genera como consecuenciaque la propiedad sea siempre un tema de suma importancia para un Estado.
