Summary:The Colombian State, when endorsing the oil activity establishes a risk, which is why it is appropriate that it responds for environmental damages that are caused in its material execution. Considering that the exploitation of nonrenewable natural resources must be carried out in a sustainable manner, to the extent that it is an obligation and an important source of income for the Colombian State. In accordance with the principle of equity, equality of public charges, and environmental sustainability, damages to individuals or the community must be compensated, since they are not obliged to bear the injuries or property damage, since State is the creator and the beneficiary.
