This paper takes this analysis exercise, showing that the measures actually result in more exclusion for this group of people suffering from these diseases. To demonstrate the above a critical analysis of the application of the concepts of risk and assurance under the conception of state and motivations of the Act becomes orphan diseases.Los indicadores de salud en el país, por lo menos en cobertura, parecerían mejorar cada vez más, permitiendo afirmar que los esfuerzos del gobierno por una cobertura universal se están cumpliendo. Sin embargo, la reforma a la salud (Ley 100) y las sucesivas reformas a esta merecen una revisión a profundidad, en particular la ley para la atención de enfermedades huérfanas. El presente documento realiza este ejercicio de análisis, evidenciando que, en realidad, las medidas generan más exclusión para el grupo de personas que padecen este tipo de enfermedades.
