description Esta investigación parte de la base de la inexistencia de una causal taxativa que permita el divorcio por voluntad unilateral de alguno de los cónyuges en Colombia. Para dar fundamento a su existencia, se estudia la distinción entre matrimonio y familia, oposición que permite acoger nuevamente el matrimonio como contrato con finalidades predispuestas como base del negocio jurídico, ello implica interpretar la causal de divorcio número dos del artículo 154 del Código Civil y realizar una ponderación de derechos fundamentales, a saber el libre desarrollo de la personalidad y el derecho a la familia.
