Dosis personal y el derecho del libre desarrollo de la personalidad (consumidores vs no consumidores)

In the present article on the personal dose and the right of the free development of the personality (consumers vs. non-consumers), (case report), relevant aspects of the beginnings of drug trafficking up to the present are taken up again. In the same sense, it highlights the parallel regulations of these against the sinister criminal phenomenon, which highlights the State's effort to address this scourge, which instead of decreasing has mutated in its breadth and depth, mimicking society and the economy, although not in a generalized way, repressing those who consume the minimum dose, while the big bosses continue to strengthen their domes. Finally, the judgments of two jurisprudences of the Constitutional Court (C-221/94 and C-253/19) are confronted, which generate uncertainty, without carrying out an in-depth analysis, on the part of scholars in the field and of those who do not they are. It is concluded that the treatment given to drug users by the State, has been repressive equating them with the criminals who are dedicated to this unfortunate business, because it lacks a comprehensive public health policy that gives them the attention they deserve with the accompaniment of the family, of the society and the support of the State, in such a way, that the minors are educated, their parents in the prevention and risks generated by drug addiction.
