description	With the promulgation of the new code of the N ational Poli ce for coexistence (law 1801 from 2016) resurge a debate o ver the faculties that have been given to the Police Authorities related with the function and prevention of crimes and the protection of human life established in the Articles 2nd and 218th of the 1991 constitution in fulfillment of wich they could restrict people's personal freedom in the cases where for established reasons by the code of rules. In the past under the validity of the mentioned code of rules of the Police (resolution 1355 of 1970) this kind of measurement where declared unconstitutional by the Supreme Constitutional Court for considering that they infringed the principal of Judicial reserve and they resulted desproporcionate to the objective pursued. Recently the sentence (C-281 of June 13, 2017) of the Constitutional Court introduced a change of the juridisprudencial line when it appointed that what was prepared by the code of rules only could apply in the municipalities that counted with the adequate places of attention and protection of all people that had been moved. The análisis of the theme identifying the way the police authority restrics people's personal freedom is infringed or protects the human rights of the habitants ofMuzo's municipality.

En el pasado, bajo la vigencia del anterior Código de Policía (Decreto 1355de 1970), este tipo de medidas fueron declaradas inconstitucionales por la Corte Constitucional, por considerar que vulneraban el principio de reserva judicial y resultaban desproporcionadas frente al fin que se perseguía.Recientemente, la Sentencia C-281 del 13 de junio de 2017 de la Corte Constitucional introdujo un cambio en la línea jurisprudencia!, al señalar que lo dispuesto por el Código solo se podrá aplicar en los municipios que cuenten con los lugares adecuados de atención y protección de personas trasladadas.El análisis realizado sobre el tema apuntó a identificar si la forma como las autoridades de policía restringen la libertad personal vulnera o protege los derechos humanos de los habitantes del municipio de Muzo Boyacá.Avec la promulgation du nouveau Code national de la police et de la coexistence (loi 1801 de 2016), le débat sur les pouvoirs conférés aux autorités policieres, liés a la fonction de prévention de la criminalité et de protection del vie, établis dans les articles 2 et 218 de la Constitution politique de 1991, a refait surface, en vertu desquels elles peuvent restreindre la liberté personnelle dans les cas et pour les raisons établis par la loi. Dans le passé, sous le précédent code de police (décret 1355 de 1970), ce type de mesure a été déclaré inconstitutionnel par la Cour constitutionnelle, au motif qu'il violait le principe de réserve judiciaire et était disproportionné par rapport au but poursuivi. Récemment, l'arret C-281 de la Cour constitutionnelle du13 juin 2017 a introduit un changement dans la ligne de la jurisprudence, en indiquant que les dispositions du code ne peuvent etre appliquées que dans les municipalités qui disposent de lieux adéquats pour la prise en charge et la protection des personnes transférées. L'analyse menée sur le sujet visait a déterminer si la maniere dont les autorités de police restreignent la liberté individuelle violé ou protege les droits de l 'homme des habitants de la municipalité de Muzo Boyacá.Com a promulgação do novo Código Nacional de Polícia e Coexistência (L ei 1801 de 2016), ressurgiu o debate sobre os poderes conferidos as autoridades policiais, relacionados com a função de preven9ao do crime e proteção da vida, estabelecida nos artigos 2° e 218° da Constituição Política de 1991, em cumprimento do qual podem restringir a liberdade pessoal nos casos e pelas razoes estabelecidas na lei. No passado, ao abrigo do anterior Código de Polícia (Decreto 1355 de 1970), este tipo de medidas foi declarado inconstitucional pelo Tribunal Constitucional, por violar o princípio da reserva judicial e por ser desproporcionado em rela9ao ao objetivo prosseguido. Recentemente, o Acórdão do Tribunal Constitucional C-281, de 13 de junho de 2017, introduziu urna alteração na linha de jurisprudência, afirmando que as disposições do Código só podem ser aplicadas em municípios que disponham de locais adequados para o atendimento e proteção de pessoas transferidas.
