Summary:This article presents the evolution and analysis of the right to health protection as a human right in relation to the Mexican context, the development of public policies and the performance of the Health System during the past years in order to guarantee the equal and universal access. A brief review regarding the problematic around the legal nature and the enforceability of the economic, social and cultural rights in a general context and then address the issue to the Mexican legal order.
