LOS SISTEMAS DE ADMINISTRACIÓN DE TIERRAS COMO SALVAGUARDA DE LOS DERECHOS DE PROPIEDAD

Los sistemas de administración de tierras son importantes en la preservación de los derechos de propiedad porque coadyuvan en el mantenimiento de la convivencia y el respet oa las reglas institucionales, no obstante, ellos deben ser adecuados tecnológicamente de manera que suministren información legal pertinente, oportuna y veraz, pues un sistema sin esos atributos promoverá el efecto contrario al esperado. Aquí se analiza el caso de una provincia de Santander, Colombia y a partir de lo encontrado se sugiere alternativas para la optimización de la información predial, que apegadas al marco legal aseguren los derechos de propiedad y sus efectos benéficos sobre los mercados de tierras al garantizar la transparencia de las transacciones, certidumbre en la dimensión física de la propiedad y permanencia en el tiempo de las referencias de límites, lo mismo que el valor real de la propiedad.AbstractThe land administration systems are very important in the property rights conservation because they contribute to the maintenance of coexistence and respect to institutional rules however they must be technologically adapted to supply relevant legal, timely and truthful information because a system without these attributes will promote the opposite effect than those expected. Here we analyze the case of a province of Santander, Colombia, and from these findings some alternatives are suggested for the optimization of property information, which are attached to the legal framework to ensure property rights and its beneficial effects on land markets to ensure transaction transparency, certainty in the physical dimension of ownership and permanence in time references of limits, the same as the real value of the property.
