La manipulación genética con su desarrollo y evolución ha traído una serie de cuestionamientos y alteraciones en el orden de lo científico, lo médico y lo jurídico alrededor de la esfera. Partiendo de criterios de la moral y los paradigmas de la bioética se ha conformado su regulación, que en principio ha sido generada por organizaciones internacionales como la ONU establecida por medio de pactos y convenciones. En Colombia los alcances de este tipo de desarrollo científico han tenido una menor influencia, y la normatividad vigente solo se ha centrado en la consagración penal de conductas contrarias a lo establecido internacionalmente; es entonces necesaria la reforma del arquetipo por medio del cual se ha intentado alcanzar de manera óptima la evolución jurídica, permitiendo al Estado colombiano la cabida de un desarrollo médico y científico que a largo plazo sea implementado para mejorar la calidad de vida de los ciudadanos, teniendo presente y como máxima guía el Derecho a la salud; logrando así que por medio de la intervención genética el Estado pueda reducir las cargas depositadas sobre este generadas al actuar como máximo protector del bienestar de aquellos que están bajo su tutela y al mismo tiempo le permita acceder a nuevos horizontes. |
