description In modern constitutionalism a series of principles have emerged, tending to develop the substantive nature of the higher norms and, within them, the preponderance that has acquired the principle of proportionality, which in penal matters allows to establish adequately the minimum and maximum limits of penalties, is unquestionable. being also, the main criterion to define the penalty in the concrete case; likewise, the aforementioned principle allows establishing a differentiated application of sentences in ordinary and transitional justice, noting that in the latter, restorative justice is privileged over retributive justice. In this regard, the application of the principle of proportionality is essential both in the legislative phase and at the time of the judicial application of the penalty; therefore, the amount of these should not exceed the magnitude of the seriousness that for society represents the punishable act that is sanctioned, and in parallel the establishment and imposition of derisory penalties, seriously violate the aforementioned principle; which, however, admits exceptions in transitional justice processes through which it intends to integrate various efforts in order to face the consequences of massive violations and widespread or systematic human rights abuses, suffered in the development of an armed conflict, with the purpose of building paths of peace, respect, reconciliation and consolidation of democracy; it is precisely for this reason that the application of the aforementioned principle in legislative processes and in legal and administrative proceedings acquires a huge preponderance, because if the essential postulates that stem from this principle are not met, there will be no truth, nor justice, nor proportional reparation and therefore, it will not be fulfilling the duty of peace and will not enjoy this such right.

En tal sentido, la aplicación del principio de proporcionalidad es imprescindible tanto en la fase legislativa como en el momento de la aplicación judicial de la pena; por tanto, el monto de estas no deben exceder la magnitud de la gravedad que para la sociedad representa el hecho punible que es sancionado, y paralelamente el establecimiento e imposición de penas irrisorias, quebrantan gravemente el precitado principio; el cual, sin embargo, admite excepciones en procesos de justicia transicional a través de la cual se pretende integrar diversos esfuerzos a fin de enfrentar las consecuencias de violaciones masivas y abusos generalizados o sistemáticos en materia de derechos humanos, sufridos en desarrollo de un conflicto armado, con el propósito de construir caminos de paz, respeto, reconciliación y consolidación de la democracia; es precisamente por ello, que la aplicación del mencionado principio en los trámites legislativos y en las actuaciones jurídicas y administrativas adquiere descomunal preponderancia, pues de no acatar los postulados esenciales que dimanan de este principio, no habrá verdad, ni justicia, ni reparación proporcional y por tanto, no se estará cumpliendo con el deber de la paz y de contera no se gozara de tal derecho.Dans le constitutionnalisme moderne, une série de principes ont surgi, tendant à développer le caractère substantif de normes supérieures et à l’intérieur de ceux-ci, il est indubitable, la prépondérance qui a acquis le principe de proportionnalité, qui en matière pénale permet d’établir convenablement les limites minimales et le maximum des peines, en étant de plus, le critère principal pour définir la peine dans le cas concret. De la même manière, le principe précité permet d’établir une application différenciée des peines par la justice ordinaire et transitionnelle, en remarquant la justice transitionnelle privilégie la justice réparatrice, face à la rétributive. De telle sort que l’application du principe de proportionnalité est indispensable dans la phase législative et au moment de l’application judiciaire de la peine. C’est pourquoi, la somme de ces peines ne doit pas excéder l’ampleur de la gravité qui représente pour la société le fait punissable qui est sanctionné. Parallèlement, l’établissement et l’imposition de peines dérisoires enfreignent gravement le principe précité.Toutefois ce principe admet des exceptions dans les processus de justice transitionnelle à travers la laquelle, de divers efforts essaient d’être intégrés pour faire face aux conséquences de violations massives et d’abus répandus ou systématiques en matière des droits de l’homme subis dans développement d’un conflit armé, avec le propos de construire des chemins de paix, de respect, de réconciliation et une consolidation de la démocratie. C´est pour cela que l’application du principe mentionné auparavant, dans les formalités législatives et dans les rôles juridiques et administratifs acquiert une prépondérance extraordinaire, puisque si les postulats essentiels qui proviennent de ce principe ne sont pas respectés, il n’y aura pas de vérité, ni de justice, ni de réparation proportionnelle et donc, le devoir de la paix ne sera pas accompli, et d’embout tel droit ne sera pas profité.No constitucionalismo moderno, surgiram uma série de princípios tendentes a desenvolver a natureza substantiva de padrões mais elevados e, dentro deles, a preponderância que adquiriu o Princípio Da Proporcionalidade é inquestionável, que em matéria penal permite estabelecer adequadamente os limites mínimo e máximo de sentenças, sendo também o principal critério para definir a penalidade no caso específico; da mesma forma, o mencionado princípio permite estabelecer uma aplicação diferenciada de sentenças na justiça ordinária e transicional, observando que, na segunda, a justiça restaurativa é privilegiada em detrimento da justiça retributiva.
