En los últimos años se ha advertido un importante proceso de constitucionalización del proceso penal, que se hizo visible especialmente con el Código de Procedimiento Penal del año 2000 (Ley 600 de 2000) y se afianzó con el expedido a propósito de la implementación del sistema oral acusatorio (Ley 906 de 2004), lo que constituyó un enorme esfuerzo por hacer coherente la legislación penal con las obligaciones internacionales adquiridas por Colombia y plasmadas muchas de ellas en tratados y convenios suscritos y aprobados internamente; y como muestra de ello, en estas dos codificaciones, explícitamente se dispone que los tratados y convenios internacionales deberán ser aplicados dentro del proceso penal, particularmente aquellos que versen sobre derechos humanos, al hacer parte del bloque de constitucionalidad. |
