Description
Summary:The objective of the article is to expose a possible generator of legal problems, in the sense of studying epigenetics and the variable conditions of the human program faced with environmental, social and legal factors. Likewise, we will describe the argumentative gaps that derive from the case under study, especially when they are related to such critical issues as, the theory of damage, non-contractual liability, labor discrimination, among others. This being the case, the argumentative gaps caused by epigenetics could translate into legal uncertainty that would imply an assumption of possible violations of fundamental rights. Analyzing, also, a solid response to said legal uncertainty will be another of the fronts to show in this article, | which, may be presented under the importance of judicial decisions, as a main expression, but also public policies and the application of the precautionary principle.
