According to the above, the deductive, historical and descriptive methodology will be used, because it will proceed to analyze the precautionary measures unnamed since its origin, its characteristics and what was proposed by the Constitutional Court, in terms of jurisdictional functions of the National Direction of Copyright and the provenance of precautionary measures unnamed as competences of this entity. Concluding that precautionary measures are not enough, and it is necessary to resort to the precautionary measures unnamed, as a legal tool of the administrative officer,without this imply prejudgment and arbitrariness in the process.

Concluding that precautionary measures are not enough, and it is necessary to resort to the precautionary measures unnamed, as a legal tool of the administrative officer,without this imply prejudgment and arbitrariness in the process.Las medidas cautelares innominadas en la protección de los derechos de autor en Colombia, han generado interpretaciones judiciales confusas, causadas por el ejercicio de funciones jurisdiccionales por autoridades administrativas, por ello se requiere describir las funciones jurisdiccionales de la Dirección Nacional de Derechos de Autor, respecto a las medidas cautelares y su importancia en la protección de los derechos de autor y conexos, en este sentido, se utilizará la metodología de tipo deductivo, histórico y descriptivo por cuanto procederá a analizar las medidas cautelares innominadas desde su origen, sus características y lo propuesto por la Corte Constitucional, en materia de funciones jurisdiccionales de la Dirección Nacional de Derechos de Autor y la procedencia de las medidas cautelares innominadas como competencias de esta entidad. Concluyendo que las medidas cautelares nominadas no son suficientes, y quese hace necesario acudir a las medidas cautelares innominadas, como herramienta jurídica del funcionario administrativo, sin que con ello implique prejuzgamiento y arbitrariedad en el proceso.Les mesures préventives innomées dans la protection des droits d’auteur en Colombie ont suscité des interprétations judiciaires confuses, provoquées par l’exercice des fonctions judiciaires des autorités administratives. Par conséquent il est nécessaire de décrire les fonctions judiciaires de la Direction Nationale du Droit d’Auteur, par rapport aux mesures de précaution et leur importance dans la protection des droits d’auteur et des droits connexes , à cet égard, sera utilisé la méthode déductive, historique et descriptive pour ensuite procéder à examiner les mesures préventives innomées depuis son origine, ses caractéristiques, et ce qui a été proposé par la Cour constitutionnelle en matière des fonctions judiciaires de la Direction Nationale du Droit d’Auteur, et l’origine des mesures préventives innomées comme compétence de cette entité.
