La inaplicación excepcional de la detención preventiva en el Juzgado Tercero Promiscuo Municipal de Apartadó con funciones de garantía y la afectación a la libertad y a la presunción de inocencia

This paper develops the concept and nature of security measures, as well as its importance as a precautionary measure in the preliminary stage of criminal proceedings, which may or may not affect the fundamental right of freedom. This composition is developed under the analysis of different meanings that allow us to glimpse the consequences of improper application of security measures and can see the importance of affecting only exceptionally freedom, the need to understand that not only preventive detention is a effective assurance measure. For this reason, security measures not custodial that can meet the purposes specified by the legislature, supported from practical concepts exemplified from the experience of litigation, doctrine and jurisprudence are addressed. For the development of this work the following topics will be addressed, namely: 1. Establish clearly the purpose of the detention preventiva.2. From the legal regulations indicate the benefits of the exceptional application of preventive detention as a measure of aseguramiento.3 Exposing the fundamental rights and procedural guarantees affected in the misapplication of the measure aseguramiento.4. To express the various measures which are not assurance custodial that can be applied without affecting freedom. This research is a documentary development, using the most relevant literature. Similarly, for thematic development are considered some jurisprudence issued by the Constitutional Court, as well as some laws.
