Summary: | The 4th Paragraph of Legislative Act 01 of 2005, introduced a modification with regard to the transitional regime enshrined in Article 36 of Law 100 of 1993, this regime sought to protect acquired rights against the recognition of an old-age benefit, annulled by complete with the issuance of this legislative act the possibility of obtaining an old-age pension under a more favorable rule, imposing the application of a subsequent rule that increased the requirements to access the old-age economic benefit, omitting entirely that the right to social security is inalienable, justifying such transgression of fundamental rights, on the principle of financial sustainability, this new constitutional norm being an unconstitutional rule wrongly justified under that principle. |
