Summary: | The Judgment of the Inter-American Court in the Artavia Murillo case "in vitro fertilization" and others v. Costa Rica, plays a fundamental role in the study of the right to life at its maximum expression, within the jurisdiction of the States party to the inter-American system . The aforementioned sentence constituted an important juridical precedent in giving light and establishing the moment in which the human person acquires the protection of this right in a general way and especially within the techniques of assisted reproduction (hereinafter TRA), like the In vitro Fertilization , Stating that the moment in which the human being is covered by such prerogative is only up to the moment of the implantation of the zygote in the maternal womb; The foregoing as a result of an analysis carried out by this corporation of Article 4.1 of the ACHR. For this reason, the present work is aimed at analyzing the considerations that the Inter-American Court of Human Rights had, and trying to understand the extent to which the right to life is granted, by virtue of the aforementioned judgment, as well as The external characteristics that allowed to discern the moment of conception, as the beginning of the faculty of enjoyment of the same. On the other hand, it is intended to provide a contribution in the sense of understanding the need and importance of accepting the jurisprudence of the Inter-American Court of Human Rights in order to rethink the internal regulations of the States Parties. |
