Summary: | The principle of progressivity preached in pension rights, it aims to leave them materializing an advanced, evolved and not regressive way. However, with the issuance of Legislative Act 01 of 2005, by which Article 48 of the Constitution is amended, has blatantly violated this principle, from the point of view that ends with the legitimate expectations of those who sought access his pension. This without considering that the principle of progressivity emerged from international instruments and standards, so that when issuing the legislative act, it had applied the constitutional law, to analyze its constitutionality, since with it were abolished so rotunda, guarantees social security in pension matters, taking retrogressive measures that affect an entire population. |
