description Este articulo analiza la problemática existente de los colombianos que son concedidos o requeridos en extradición a los Estados Unidos, en relación con la vulneración de sus derechos fundamentales en los distintos momentos del proceso en general. Dado que, debe garantizarse los derechos y principios previstos en la constitución. Sumado a ello, no pueden imponerse penas ni tratos que no se prevean en el país origen, como por ejemplo la pena de muerte, o tratos como la tortura. Se analizarán otros conceptos transversales a la problemática, como lo son la soberanía, derechos humanos, desarrollo jurisprudencia, entre otros.
