Con toda certeza, podemos afirmar que la constante evolución en que se encuentran los mecanismos judiciales, han llevado a que gran parte su tramitología cambie de manera continua, esto, lejos de que se trate de un obstáculo o inconveniente a la hora de iniciar un proceso judicial, por el contrario, el objetivo del gobierno nacional y los mecanismos internacionales a través de los años ha sido simplificar, modernizar y priorizar el uso de las Tecnologías de la Información y las Comunicación (TICS); no obstante, a pesar de los esfuerzos alcanzados, no se ha propendido por que tales mecanismos sean plenamente aprovechados e implementados en que hacer judicial. Al punto, tratándose de notificaciones personales, que de no ser por el Decreto Legislativo 806 de 2020 y su implementación en medio de una Pandemia, a la fecha seguiríamos realizando tales actuaciones judiciales de manera presencial en las sedes judiciales conforme lo establecido en el artículo 291 y subsiguientes del Código General del Proceso, practica esta, llamada a desaparecer no solo por la poca practicidad que genera, sino también el desgate a las partes y al proceso judicial en sí. |
