La contingencia generada por la emergencia sanitaria del COVID-19 durante el año 2020 y declarada como pandemia, trajo consigo consecuencias a nivel social y sobre todo a nivel jurídico en lo concerniente a las medidas que tuvo que implementar el Gobierno Nacional para regular y en cierta medida conjurar la crisis que se estaba viviendo, y que para la comunidad en general era totalmente desconocida. Las atribuciones de las que se valieron en ese entonces produjeron inconformidades de parte de todos los sectores y a su vez provocaron que algunas de las medidas expedidas e implementadas con el ánimo de mitigar los daños, tuvieran que ser revisadas en cuanto a su contenido material y formal ya que vulneraban derechos fundamentales. Se abordan temas como la inconstitucionalidad de actos, la división de poderes y la extralimitación de facultades. |

The powers that were used at that time produced disagreements from all sectors and in turn caused that some of the measures issued and implemented with the purpose of mitigating the damages, had to be reviewed in terms of their material and formal content since they violated fundamental rights.
