description En este avance de investigación se encaminó a lograr identificar la normatividad aplicable tanto internacional como nacional del desguace de buques, entendiendo esta práctica como parte fundamental de la contratación marítima, por lo cual, se planteó el interrogante referente a cuál es el régimen jurídico internacional y colombiano que regula el desguace y reciclaje de materiales de los buques y qué impacto tiene en los agentes que intervienen en dicha práctica. Así las cosas, usando el método descriptivo, se estableció la importancia que tiene el proceso del desguace de buques en la industria marítima, a partir del análisis de la normatividad aplicable a la práctica desde el ámbito internacional y nacional, lo cual permitió establecer en conclusión las dificultades que se presentan en la práctica del desguace de buques y la oportunidad que puede presentarse para Colombia desde el punto de vista de la creación de una nueva industria que tiene referentes en latinoamericana
