La tecnología, la robótica, la inteligencia artificial, el internet de las cosas y la big data son términos adaptados al leguaje natural y hacen referencia a la cuarta revolución industrial o la Revolución 4.0. Estos términos se usan a diario y no siempre se entienden por completo, sin embargo, todas las personas las incluyen en su vocabulario pues hoy en día no se puede tener una conversación sin incluirlas dentro de la discusión. En este artículo se analizan estos factores en relación con la legislación laboral existente en esta materia, en el primer acápite, se desarrolla el marco conceptual donde se delimitan los conceptos de Revolución 4.0, inteligencia artificial, robótica, internet de las cosas y big data, adicionalmente, se puntualiza sobre su uso en relación al ámbito laboral. En el segundo acápite, se encuentra el marco normativo o legal, en este se exponen las leyes, tratados o jurisprudencia referente a la investigación, es decir, se especifica la información existente en relación a la protección de los derechos laborales en materia de la sustitución laboral, también, se abordan los conceptos de robótica e inteligencia artificial en materia de legislación del trabajo y los casos que dan cuenta de dicha protección o desprotección. Finalmente, en el último acápite, se realiza un análisis de la documentación teórica en relación al marco legal encontrado, esto, con el fin de responder al objetivo del artículo, el cual consiste en poner en evidencia que tan preparada esta la legislación del trabajo para afrontar la Revolución 4.0. |

These terms are used daily and they are not always fully understood, however, all people include them in their vocabulary because today, nobody can have a conversation without including them in the discussion. In this article these factors are analyzed in relation to the existing labor legislation in this matter, in the first section the conceptual framework is developed, the concepts of revolution 4.0, artificial intelligence, robotics, internet of things and big data are delimited, additionally, it points out its use in relation to the labor matters. In the second section the normative or legal framework is found, in which the laws, treaties or jurisprudence regarding this investigation are exposed, that means, the existing information in relation to the protection of labor rights in terms of labor substitution. Also, the concepts of robotics and artificial intelligence in terms of labor legislation are addressed in cases that are evidence of the protection or lack of protection.
