El impacto de la inteligencia artificial (IA) en los derechos de autor y las implicaciones legales es el tema principal de este artículo reflexivo. El surgimiento de la inteligencia artificial ha rediseñado el proceso de creación y generación de contenido, planteando múltiples desafíos legales, sin precedentes entre estos, está el campo de derechos de autor. Este artículo se centra en tres objetivos fundaméntales para abordar estas implicaciones. En primer lugar, se examinará cómo la inteligencia artificial ha transformado la creación de obras protegidas por derechos de autor, investigando las nuevas perspectivas que ofrece los desafíos que presenta a los creadores y titulares de derecho. De igual forma se analizarán las legislaciones y regulaciones existentes en un contexto nacional e internacional en relación con la propiedad intelectual y la inteligencia artificial. Esto permitirá entender cómo los marcos legales actuales se adaptan a esta nueva tecnología. Por último, se realiza un análisis comparativo entre las diferentes políticas y regulaciones en varias jurisdicciones, buscando enfoques diversos en la relación entre la inteligencia artificial y los derechos de autor a nivel mundial. A través de este artículo reflexivo, se busca comprender la interacción entre la creatividad humana y la IA, con el propósito de contribuir al desarrollo de las políticas que aseguren una protección efectiva de los derechos de los creadores de contenido en este entorno cambiante y dinámico. |

The emergence of artificial intelligence has redesigned the process of creating and generating content, posing multiple legal challenges, unprecedented among these is the field of copyright. This article focuses on three key objectives to address these implications. First, it will examine how artificial intelligence has transformed the creation of copyrighted works, investigating the new perspectives it offers on the challenges it presents to creators and right holders. Likewise, existing legislation and regulations will be analyzed in a national and international context in relation to intellectual property and artificial intelligence. This will allow us to understand how current legal frameworks adapt to this new technology. Finally, a comparative analysis is carried out between different policies and regulations in various jurisdictions, seeking diverse approaches to the relationship between artificial intelligence and copyright worldwide.
