La implementación de la figura feminicidio dentro del ordenamiento jurídico como delito penal autónomo es un acontecimiento reciente, pues a pesar de estar enmarcado en una problemática de violencia que ha sido recurrente y sistemática en el país, sólo fue por medio de la jurisprudencia que se logró su visibilización y reconocimiento, hasta lograr su normatización a través de la Ley 1761 de 2015, conocida también como Ley Rosa Elvira Cely. La investigación permitió evidenciar un avance significativo con relación al reconocimiento del delito por parte del legislador, el cual fue tipificado y caracterizado dentro del Código Penal Colombiano, esto a partir de la expedición de la Ley 1761 de 2015, la cual define el término feminicidio como “causar la muerte de una mujer por su condición de ser mujer o por motivos de su identidad de género”. Se realizó también un análisis sobre las sentencias hito de la Corte Suprema de Justicia y la Corte Constitucional expedidas desde el año 2015 hasta el año 2022 con la finalidad de observar las diferentes líneas jurisprudenciales de las Cortes anteriormente mencionadas, que permitieron el reconocimiento del delito y entender cuáles fueron los cambios jurídicos que se generaron. De estas modificaciones, surge la obligación del juzgador de investigar a profundidad los motivos de la conducta y la relación del sujeto activo y la víctima, con el fin de identificar si se trata de un delito por motivo de género, por lo que debe aplicarse el feminicidio o si se tipifica como homicidio. Lo anterior, no solo trae cambios en la forma de investigar la conducta, sino también en el tipo penal aplicable y, por tanto, la pena que debe imponerse. |

The investigation made it possible to demonstrate a significant advance with regard to the recognition of the crime by the legislator, which was defined and characterized within the Colombian Criminal Code, this from the issuance of Law 1761 of 2015, also known as the Rosa Elvira Cely Act, which defines the term femicide as "causing the death of a woman because of her status as a woman or because of her gender identity". An analysis was also made of the landmark judgments of the Supreme Court of Justice and the Constitutional Court issued from 2015 to 2022 in order to observe the different jurisprudential lines of the aforementioned Courts, that allowed the recognition of the crime and understand what legal changes were generated. From these modifications, the obligation arises for the judge to investigate in depth the motives of the conduct and relationship of the active subject and the victim, in order to identify if it is a gender-based crime, so femicide should be applied or if it is classified as homicide.
