A lo largo de la historia el ser humano ha alcanzado sus objetivos con la ayuda de otros por medio de acuerdos privados, circunstancia que ha hecho del negocio jurídico uno de los instrumentos jurídicos mas importantes desde antaño. El propósito de este texto es analizar las diferentes etapas del negocio jurídico a partir de un estudio crítico de las mismas, tratando de exponer las principales discusiones que se han presentado respecto de diferentes temas relativos al iter negocial por parte de la doctrina. Así mismo se busca evidenciar algunas de las principales dificultades que se presentan a lo largo del iter negocial, tales como conflictos de aplicación normativa, dificultades que se presentan en el marco de la responsabilidad civil, multiplicidad de criterios jurisprudenciales y doctrinales frente a un mismo problema jurídico, falta de claridad acerca del inicio y fin de cada etapa, el momento a partir del cual la oferta surte efectos, la obligatoriedad de la oferta dirigida a personas indeterminadas, la prolongación de los deberes derivados de la buena fe a etapas posteriores a la pre-negocial, entre otros.It is undeniable that the contract is the most used and important legal vehicle to meet human needs. Throughout history, human beings have achieved their objectives with the help of others through private agreements, a circumstance that has made the contract one of the most important legal instruments since ancient times. The purpose of this text is to analyze the different stages of the contract from a critical study of them, trying to expose the main discussions that have been presented regarding different issues related to the contract phases by the doctrine.
