This article argues that the constitutional protection of political satire is fundamental for the state and democracy, as it strengthens the mechanism of checks and balances, and the balance of powers, which in nations such as Colombia has not been consolidated. In this sense, starting from the classic formulation of the doctrine of the division of powers and its application in Latin America, the impact of political satire in the modern state will be analysed.Es común referirse al derecho a la libertad de expresión como base o sustento de la democracia; sin embargo, pocas veces se analizan las implicaciones en la teoría constitucional de esta afirmación. Este artículo sostiene que la protección constitucional de la sátira política es fundamental para el Estado y la democracia, ya que fortalece el mecanismo de frenos y contrapesos, y el equilibro de poderes, que en naciones como Colombia no se ha consolidado.
