Of equal form, the type of criminal law, against which one fights against the phenomenon of the diversion shows us the type of society who tries self to agree, it(she,I) is(am) this democratic or totalitarian. Because of it, the problem of the repression is central in the current theory of the State. The peoples(villages) since(as) ours have strained for obtained a society that simultaneously that allows the exercise of the individual freedoms, it(he,she,I) allows(allow) the above mentioned exercise of freedoms inside the frame of a Social State of right, which can give response to his(its,her) expectations of material justice.Para el autor, la pena resulta ser elemento determinante en la configuración de cualquier sistema de control social, y el derecho penal, el instrumento de control social más riguroso que conocen las modernas sociedades. De igual forma, el tipo de derecho penal con el cual se lucha contra el fenómeno de la desviación nos muestra el tipo de sociedad que se trata de conformar, sea democrática o totalitaria. Por eso, el problema de la represión es central en la actual teoría del Estado. Los pueblos como el nuestro se han esforzado por conseguir una sociedad que a la vez que permita el ejercicio de las libertades individuales, lo haga dentro del marco de un Estado Social de Derecho, que pueda dar respuesta a sus expectativas de justicia material.Para o autor, a pena acaba sendo um elemento determinante na configuração de qualquer sistema de controle social, sendo o direito penal, o mais rigoroso instrumento de controle social conhecido pelas sociedades modernas. Da mesma forma, o tipo de direito penal com o qual o fenômeno do desvio é combatido nos mostra o tipo de sociedade que ele está tentando formar, seja ela democrática ou totalitária. Por isso, o problema da repressão é central na teoria atual do Estado.
