This is done starting from la laguna de Gödel, which demonstrates the importance of constitutional interpretation and provides an approach to Guastini’s definition of judicial activism. There is also a review of the Greek myth of the god Hermes with which an ethical framework of the hermeneutic task is built in order to understand its depth. The discoveries of the Greek myth allow a deeper understanding of the new hermeneutical and jurisprudential trends.El propósito de este trabajo es hacer una revisión filosófico-conceptual del poder hermeneuta y su rol en la legitimación, definición y conceptualización de discursos institucionales y jurídicos. A partir de la laguna de Gödel, con lo cual se evidencia la importancia de la interpretación constitucional, se hace un acercamiento a la definición de activismo judicial de Guastini. Luego hay una revisión del mito griego del dios Hermes y se construye un marco ético de la tarea hermenéutica con el fin de aprehender su profundidad.
