Summary: | Este artículo aborda la problemática inherente a las mutaciones constitucionales que se materializan en los cambios que sufre el texto constitucional, al margen del proceso formal de reforma previsto para tal efecto.Las mutaciones constitucionales tienen diferentes orígenes. Lo cierto es que tanto la práctica de los órganos del Estado como la vida cotidiana de la sociedad, constantemente someten al texto constitucional a duras pruebas que ponen en tensión lo que dice la lex fundamentalis con la forma en que opera la realidad de la sociedad y el Estado.El problema central en esta cuestión, reside en la ausencia de controles sobre esas mutaciones que ocurren sin que el texto constitucional sufra modificaciones a su texto.Nos parece que para atender adecuadamente esta problemática, es necesaria la creación de un Tribunal Constitucional que se encargue, tanto del control constitucional de las reformas (proceso formal), como de las propias mutaciones constitucionales (proceso fáctico); todo ello, en aras de garantizar la supremacía de la ConstituciónABSTRACTThis article discusses the problems inherent constitutional mutations expressed in changes that suffers from the constitutional text, apart from the formal process of reform foreseen for this purpose.Constitutional mutations have different origins.
