Reflexiones sobre un nuevo mapa constitucional

No obstante las diversas críticas de que ha sido objeto, la Constitución de 1991 refleja las aspiraciones del momento en que se gestó; su evolución posterior ha estado marcada por la jurisprudencia de la Corte Constitucional, la cual se ha visto orientada por valores y la búsqueda de principios que superan su texto, por lo que la construcción de un nuevo mapa constitucional en el país impone la necesidad de una reforma estructural de éste ente con objeto de limitar de manera prudente sus atribuciones y el acceso a su jurisdicción. De igual manera, es el momento oportuno para adelantar reformas vigorosas a la Carta de 1991 que permitan la reestructuración de los partidos políticos y el proceso electoral, el establecimiento de la disolución del Congreso como mecanismos para intermediar mediante la intervención popular, los conflictos entre entre ejecutivo y legislativo, el establecimiento de límites al Congreso frente a la modificación de iniciativas de reforma constitucional y una serie de disposiciones transitorias que permitan abrir el camino para el fortalecimiento institucional del Estado pero, al mismo tiempo, que faciliten la posibilidad de adelantar procesos de paz. Abstract Although 1991 Constitution has received a lot of criticism, it reflects the aims at the moment in which it was created. Its further evolution has been marked by the jurisprudence of the Constitutional Court, which has been oriented by values and the search of principles surpassing its text. All this has made the construction of a new constitutional map mandatory along with a structural reform of this Court aiming at limiting its attributions in a prudent way and the access to its jurisdiction. In a same way, this is the exact moment for beginning vigorous reforms to the 1991 Constitution, which permit to restructure the political parties and the electoral process, to establish the dissolution of the Congress as a mechanism to mediate–through popular intervention– the conflicts between the executive and the legislative powers, to establish limits to the Congress in front of the modifications of the indicatives of constitutional reforms and a series of temporary dispositions which allow to open the way for the institutional strengthening of the State, but at the same time to ease the possibility of carrying out peace processes.
