This principle augments the contractincompleteness and makes impossible the use of the economic incentives tocontrol the opportunism of the economic agents. The authors present thehypothesis that the economic equilibrium principle increases the conflictivenature of the public contracting. They make the empirical test of the hypothesis.The first section of the paper presents the summary of the literatureon the transaction costs economics, as well as the legal literature on thehistorical origin and the content of the economic equilibrium principle.The second section describes the methodology of the empirical study. Thethird section shows the empirical evidence of the effects that the economicequilibrium principle exerts over the public contracting. The last sectionpresents the conclusions.La contratación pública en Colombia es conflictiva, poco eficaz y eficiente; con frecuencia le causa daño patrimonial al Estado. El sistema legal colombiano no fue capaz de hacer eficiente ni transparente la contratación pública, que transcurre en un ambiente institucional caracterizado por los altos costos de transacción. La ley colombiana complica las cosas aun más con el principio del equilibrio económico de los contratos, que aumenta la contratación incompleta y dificulta el uso de los incentivos económicos para controlar el oportunismo de los agentes económicos. Los autores formulan la hipótesis de que el principio del equilibrio económico contribuye a aumentar la litigación en la contratación pública. Se hace la prueba empírica de la hipótesis. En la primera sección se hace el resumen de la literatura económica sobre los costos de transacción y el contrato incompleto, así como la literatura jurídica sobre el origen histórico del principio del equilibrio económico de los contratos. La segunda sección describe la metodología del estudio empírico. La tercera presenta la evidencia empírica de los efectos que ejerce el principio del equilibrio sobre la contratación pública.
