Additionally, it was observed that the applied standard sometimes becomes more stringent than what is established for certain processes. Furthermore, it has become evident that applying these standards makes it challenging to establish objective criteria.Se investigó el conocimiento que tanto los jueces como los árbitros tiene del concepto de estándar de prueba y la aplicación de este, así como su desconocimiento al momento de proferir la sentencia. Se identificó que se identifica el concepto, pero al momento de aplicarlo se presentan vacíos conceptuales que permitan hacerlo de una manera adecuada; observándose que estándar aplicado en ocasiones termina siendo más exigente que el establecido para algunos procesos.
