Afterwords, a review about the principles of necessity and proportionality in relation to the case is given.En este trabajo se reflexiona en torno al Auto AP10732020 del 3 de junio de 2020 (rad. 51983) de la Sala de Casación Penal de la Corte Suprema de Justicia, providencia en la cual se analizó una de las solicitudes presentadas en cuanto a la aplicación de la excepción de inconstitucionalidad frente al artículo 6° del Decreto Legislativo 546 del 2020 del proferido por el Gobierno Nacional en el marco de la pandemia provocada por el Covid19.
